Can a person EVER get dxed without there consent or taking a test?

I've noticed some say Charles Manson is Npd, but he never agreed to take a test (he is too nuts to even cooperate to that extent!).

Other "bad and crazy" people have died and yet are spoke of as disordered. I do not disagree with most of their opinions, but can they be accepted as fact?

Like Susan Smith who killed her kids in 1994 (big public case)...what if she never took a pd test? Could a shrink still, based on her actions, dx her?

Or could she not take a test (figure via example), and say: "I have never been tested so I am not disordered".

What about a fruitcake like a Manson...?

What if they will not get tested? Then what? Or what if, due to death, there was no test. Then what?

In court, you may not need to consent to a drunk driving test: They will say you're under the influence anyway.

But what is the staus quo concerning this on as many fronts as you can think of (like psychology, law, etc)?
