Rape? Or just attempted rape...

I was sexually abused by my brother for years, and I had a question about one incident that I remember. I'm not sure if it would be considered rape or just attempted rape?

I remember I was probably 10 years old, and he took me to my room and made me lay down on my bed. He then threw a blanket over my face and began to take off my clothing, waist down. I then lifted the blanket off and saw him taking his clothing off waist down as well. I was frozen in horror as he then began to spread my vagina and attempt to penetrate me with his penis using his hand. I was completely frozen and kept thinking "OH MY GOSH". I could feel it, and it was stiff and warm, and he was trying to hump me to while using his hand to force it in. My memory randomly blanks at about here, and all I sort of remember is if it did penetrate, it was probably the very tip of his penis and not the whole thing. But if his penis was touching my vagina "entrance", but not quite in, would that be considered rape as well? Or just attempted rape?

That could depend on how one sees it. I think any skin-on-skin contact between genitals that isn't consensual is rape, even if there was no penetration involved. But others might disagree and say it's not rape unless there's actual penetration. I think it only really matters in a legal sense if actual intercourse took place. Overall, I don't think it really matters because either way, it's sexual assault. It doesn't make it any less heinous if he actually raped you or not.

I didnt have to read very fare; I assume thats rape and a whole lot of other things; illegals violations.

Thank you so much for your help. It definitely cleared up a lot of things for me. I'm so fortunate to have found this forum and I really want to thank everyone who has helped me out on here!

You’re very welcome. I personally have been pleased to learn all about the progress you’ve made regarding your trauma and hope you’re able to overcome it someday. Don’t be afraid to come back should you ever find yourself needing to talk about it more.

I think your brother behaved horribly and I'd be inclined to think it was attempted rape- not a word I like to use when kids are involved but he was just too forceful and demanding and you did not want to do anything.

Thanking both of you very much Chels. This forum has really helped me cope with my trauma.
I agree Snaga, and tend to just say possibly raped or attempted rape when I tend to bring it up. But ti's good to get clarification here!!
