For anyone who has been a victim of abuse, medical malpractice, or a crime, you're probably familiar with the legal time frame restriction you have to "sue" someone in a court of law. This is known as "The Statute of Limitations".
Differing circumstances have different time allowances with the most common being 2 years in the case of "wrongful deaths", and 7 years in the case of "rental disputes" involving property or money. When Prosecutors from the County or State are involved, certain crimes have no Statue of Limitations - such as MURDER. It's noteworthy that even rape has a time frame fixed upon it. Bill Cosby is a current example where he appears immune from certain criminal prosecutions. Wikileaks founder Julian Asange was recently declared immune from questioning under Swedish law for several of the sexual accusations against him. He has one more rape allegation pending which soon also will expire. (He is currently holed up in an Ecuadorian Embassy in London hiding from arrest).
Immediately you may be struck with the blaring discrepancy. 2 years to bring a case against someone who caused death to a human being, but 7 years to sue a landlord who ripped you off from your deposit money? How can this be?
Well the short answer is - IT SHOULDN'T BE.
The Statute of Limitations is the perfect tool to aid oppressors and wrongdoers, and punish victims. Most people are ignorant of legal procedures, or don't have the time to research and launch their own investigations or bring legal cases to trial. They rely on attorneys to do this work for them.
The problem is many attorneys are only interested in money and the legal "soup dujour", or whatever is in fashion at the time. So if a case is unpopular, unknown, or doesn't bring in certain money to the attorney, most will refuse to take it on--showing you the door or ending the telephone conversation.
This leaves the victim confused.
Oftentimes, as the situation is deemed insurmountable, most victims just give up in frustration. And in 2 short years, the Statute of Limitations sets in. "Poof", a crime or abuse goes unpunished and unresolved forever. Yet lo and behold, to sue your landlord you have a whopping 7 YEARS to bring a lawsuit.
This is the dilemma we face today. It's absurdity and needs to be changed.
So whatever your situation...whether an institution force drugged you with a bad psychiatric medication that left you debilitated, or whether a plastic surgeon mangled your face, or whether someone murdered your family member....2 years is not enough time to allow for the phases of shock, denial, grieving, and acceptance to cycle through.
The Statute of Limitations must be lifted. An adverse action done against someone must never go away until the situation is properly resolved to "right the wrong" and tilt the scales of justice back in the favor of the victim.
Congress must overturn / repeal the Statute of Limitations to send the message that NO CRIME OR ABUSE WILL GO UNPUNISHED OR UNRESOLVED.
