In your endeavour to prove that without awareness there is delusion you would be going against the whole worldview of Western culture. The judge's point of reference is rationalism, not Buddhist doctrine. Maybe you could take the angle of Buddhist logic. Try to prove that both the Western worldview and the Buddhists believe in logic, and therefore there is a basis for your argument. I think Buddhist logic differs from Western, but... Also try to make Buddhism look "rational" to the jury and the judge by calling forth the doctrine of the causal arising of phenomena (everything has a cause). They should like that a lot. Anything that will rationalize Buddhism for them will be helpful.

i just have a book that is by Chogyam Trungpa called "the sanity we are born with, a buddhist approach to psychology"and it clearly defines awareness and why it is so important
