If the risk of death or bodily harm is great enough, ignoring it demonstrates a "depraved indifference" to human life and the resulting death is considered to have been committed with malice aforethought.
I just thought of that term "depraved heart" when I read what they did and also the Doctors Trials at Nuremberg. Promoted it illegally to children and the elderly, covered up the side effects and none of those psychos went to prison.
